License Agreement

This End-User License Agreement (“Agreement”) is a legal agreement between you and Kirocast (“we,” “us,” or “our”) for the Kirocast software application, including any associated media, documentation, and updates (the “Software”). By installing or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

1. Grant of license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on Apple devices that you own or control, solely for your personal or internal business use, in accordance with this Agreement.

2. Restrictions

You may not:

  • Copy, modify, or create derivative works of the Software, except as permitted by law.
  • Distribute, sell, rent, lease, sublicense, or otherwise transfer the Software to any third party.
  • Reverse engineer, decompile, or disassemble the Software, except to the extent that such activity is expressly permitted by applicable law.
  • Remove, alter, or obscure any proprietary notices on the Software.
  • Use the Software to develop a competing product or for any unlawful purpose.

3. Ownership

The Software is licensed, not sold. We and our licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any ownership of the Software or rights in our trademarks.

4. Your content

The Software captures and edits your screen recordings and exports video locally on your device. You retain all rights to that content. We claim no ownership over it and do not require any license to it in order for you to use the Software.

5. Third-party and open-source components

The Software may include third-party or open-source components that are subject to their own license terms. Those terms are made available within the Software or its documentation and govern your use of those components. To the extent any open-source license conflicts with this Agreement, the open-source license governs for that component.

6. Updates

We may provide updates, upgrades, or new versions of the Software. Unless accompanied by separate terms, such updates are part of the Software and governed by this Agreement. We are not obligated to provide any updates or to continue supporting any particular version.

7. Pre-release software

If the Software is provided as an alpha, beta, or other pre-release version, it is made available for evaluation, may contain defects, and may change or be withdrawn at any time. Pre-release Software is provided with no warranties of any kind.

8. Disclaimer of warranties

The Software is provided “as is” and “as available,” without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be error-free, that exports will render correctly, or that the Software will operate without interruption.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Software.

10. Termination

This Agreement is effective until terminated. It terminates automatically if you breach any of its terms. Upon termination, you must stop using the Software and delete all copies in your possession. Sections intended to survive termination will continue to apply.

11. Apple-specific terms

If you obtained the Software through the Apple App Store, you acknowledge that this Agreement is between you and us only, not Apple, and that Apple is not responsible for the Software or its support. Apple is a third-party beneficiary of this Agreement and may enforce it against you.

12. Governing law

This Agreement is governed by the laws of France, without regard to its conflict-of-laws rules, except where mandatory consumer protection laws of your country of residence apply.
